1. Introduction
Welcome to The Super Trainer ("Platform", "we", "us", or "our"). The Super Trainer is a B2B marketplace operated by PROMAXIMA GLOBAL (OPC) PRIVATE LIMITED (CIN: U85410KA2026OPC213694), a One Person Company incorporated under the Companies Act, 2013, having its registered office at 3rd Floor, GP Apt, Gulmohar Enclave Road, Kundalahalli, Bangalore North, Bangalore- 560037, Karnataka, India (the "Company").
These Terms of Service ("Terms") govern your access to and use of The Super Trainer platform, website (https://thesupertrainer.in), and all related services (collectively, the "Services").
By accessing, registering, or using the Services in any manner, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
2. Definitions
- "Gym" or "Gym User" refers to a fitness business (including gyms, studios, fitness centres, personal training facilities) that uses the Platform to discover, contact, and hire fitness trainers.
- "Trainer" or "Trainer User" refers to an individual fitness professional who creates a profile on the Platform to be discovered by Gyms.
- "User" refers to both Gym Users and Trainer Users collectively.
- "Credits" refers to the platform currency used by Gym Users to reveal Trainer contact information. Credits may be obtained through subscription plans, one-time credit packs, or promotional allocations.
- "Subscription" refers to a recurring monthly billing plan that provides Credits and additional Platform features.
- "Pack" refers to a one-time purchase of Credits with a fixed validity period.
3. Eligibility
To use the Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract under Indian law
- Be a resident of India (the Services are designed for and available only to users in India)
- If registering as a Gym, be authorised to represent and bind the business entity you register on behalf of
We reserve the right to refuse, suspend, or terminate Services to any User at our sole discretion.
4. Account Registration
To access most features of the Services, you must register for an account by providing accurate, current, and complete information, including a valid Indian mobile phone number for OTP verification. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately at support@thesupertrainer.in of any unauthorised use.
You agree to provide truthful, accurate information when creating your profile. Misrepresentation of your business, qualifications, or identity is grounds for immediate account termination.
5. Platform Services
5.1 For Gym Users
The Platform allows Gym Users to:
- Browse Trainer profiles
- Use Credits to reveal Trainer contact information
- Post hiring requirements (job listings)
- Receive applications from Trainers
- Express interest to Trainers via the Platform's messaging features
5.2 For Trainer Users
The Platform allows Trainer Users to:
- Create and maintain a professional profile
- Browse and apply to job listings posted by Gyms
- Receive interest and contact from Gyms
- Track interactions with the Platform's tools
5.3 Nature of Services
We are an intermediary that facilitates connections between Gyms and Trainers. We do not employ Trainers, do not guarantee employment outcomes, and are not party to any agreement that may be entered into between a Gym and a Trainer following a connection made through our Platform. Any hiring, employment, contracting, or compensation arrangements are solely between the Gym and the Trainer.
6. Payments, Credits, and Subscriptions
6.1 Subscriptions
Gym Users may subscribe to monthly recurring plans. Subscription Credits are allocated at the beginning of each billing cycle and reset on each renewal date. Unused subscription Credits do not roll over to the next billing cycle.
6.2 Credit Packs
Gym Users may purchase one-time Credit Packs. Pack Credits expire on a fixed validity date specified at purchase. Unused Pack Credits expire and are forfeited at the end of the validity period.
6.3 Pricing
All prices displayed on the Platform are in Indian Rupees (₹) and are inclusive of applicable Goods and Services Tax (GST) at 18%. Prices may change at any time at our discretion, but changes will not affect Subscriptions already active.
6.4 Payment Processing
All payments are processed through Razorpay, an RBI-authorised Payment Aggregator. By making a payment, you also agree to Razorpay's terms and policies. We do not store your card details, bank details, or any sensitive payment information on our servers.
6.5 Credit Usage
- 1 Credit = 1 Trainer contact reveal
- Once a Trainer's contact has been revealed to a Gym, subsequent views of the same Trainer's contact by the same Gym do not deduct additional Credits
- Credits have no monetary value, are non-transferable, and cannot be exchanged for cash
7. Refund and Cancellation
Our refund and cancellation policies are governed by our Refund Policy and Cancellation Policy, which form part of these Terms.
8. User Conduct
You agree NOT to:
- Use the Platform for any unlawful purpose
- Misrepresent your identity, business, or qualifications
- Scrape, harvest, copy, or systematically extract data from the Platform (including Trainer information obtained via Credit reveals) for any purpose other than your own hiring needs
- Resell, redistribute, or share Trainer contact information with third parties
- Use the Platform to send spam, harass, or solicit Users for unrelated services
- Attempt to circumvent the Credit system or any other Platform restrictions
- Reverse-engineer, decompile, or attempt to extract source code from the Platform
- Use automated tools (bots, scripts) to access the Services without our written consent
- Post false, misleading, defamatory, or discriminatory content
- Violate any applicable Indian laws, including labour laws, in your dealings with Trainers/Gyms connected via the Platform
Violation of these conduct rules may result in immediate termination without refund.
9. Intellectual Property
All content, design, branding, software, and trademarks displayed on the Platform are the property of PROMAXIMA GLOBAL (OPC) PRIVATE LIMITED or our licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purposes. No content from the Platform may be copied, reproduced, or distributed without our prior written consent.
Content you upload (profile information, photos, job descriptions) remains your property. By uploading, you grant us a non-exclusive, royalty-free licence to display, distribute, and use such content for the purpose of operating the Platform.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your information.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We make no warranties about:
- The accuracy, reliability, or completeness of Trainer or Gym profile information
- The suitability of any Trainer for any specific role
- The success of any hiring outcome
- Uninterrupted availability of the Platform
We are not responsible for the actions, omissions, qualifications, or conduct of any User. Verification of credentials, references, and suitability is the responsibility of the hiring party.
12. Limitation of Liability
To the maximum extent permitted by Indian law, in no event shall PROMAXIMA GLOBAL (OPC) PRIVATE LIMITED, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total aggregate liability to you for any claim arising out of or relating to the Services shall not exceed the amount paid by you to us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless PROMAXIMA GLOBAL (OPC) PRIVATE LIMITED from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
14. Termination
We may suspend or terminate your account at any time, with or without notice, for breach of these Terms or for any other reason at our sole discretion. You may close your account at any time by writing to support@thesupertrainer.in. Termination does not entitle you to a refund of any prepaid amounts except as set out in our Refund Policy.
15. Modifications to Terms
We may update these Terms from time to time. Material changes will be notified by email or via a prominent notice on the Platform at least 7 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
